Modifications that change a Nakheel villa's layout, exterior or built-up area, or add a pool or covered structure, need a Home Modification NOC from Nakheel before work starts. Added enclosed area carries an additional gross floor area fee. Structural work and extensions then need a building permit from the authority for the community, which in several Nakheel communities, including Jumeirah Park, is Trakhees (CED) rather than Dubai Municipality. What your plot allows depends on its villa type, size and, in Jumeirah Islands, lake setbacks.
Who approves what
Nakheel reviews modifications against the master community guidelines: plot setbacks, height, materials and the additional floor area your plot can take. The approving authority for the building permit depends on the community's jurisdiction. Many Nakheel communities fall under Trakhees, the building regulator for areas such as Jumeirah Park, while others go to Dubai Municipality. We confirm the route for your plot before drawings are prepared.
Nakheel NOCs are typically time-limited (reported at around six months), so the permit and contractor need to be ready to move once it is issued.
The Nakheel process, step by step
- Check the plot and villa type. Villa type and plot size decide what is possible: Legacy, Regional and Heritage villas in Jumeirah Park, the cluster villas of Jumeirah Islands, or Al Furjan's villas and townhouses. We check setbacks and the remaining floor area allowance.
- Concept and drawings. A registered consultant prepares the drawings: existing and proposed plans and elevations, a site plan, and structural calculations where the structure changes.
- Nakheel NOC application. The application goes through Nakheel's online services with the title deed and drawings. Larger works are reviewed in stages, often a provisional approval followed by the final NOC.
- Area fee and NOC. Where the work adds enclosed floor area, the additional gross floor area fee is calculated and paid before the NOC is issued.
- Authority building permit. Structural work, extensions and pools are submitted to Trakhees or Dubai Municipality, as applicable, with the Nakheel NOC.
- Contractor access and works. Contractor access permits are arranged, and work is carried out to the approved drawings and community rules, with staged authority inspections.
- Completion. Authority completion, Nakheel's final check, as-built drawings and the deposit refund close the project.
What each type of work needs
| Type of work | Nakheel NOC | Authority permit | What it involves |
|---|---|---|---|
| Painting, furniture, like-for-like repairs | Not usually | No | Contractor access is still arranged with the community. |
| New kitchen or bathrooms, moving plumbing | Often yes | Usually no | We confirm with Nakheel what your scope needs before work starts. |
| Removing or adding internal walls | Yes | Yes if structural | Structural assessment of any wall that is not clearly a partition. |
| External changes, facade, windows | Yes | Depends on scope | Must follow the community's architectural style. |
| Pergola or shade structure | Yes | Depends on size and structure | Open structures are reported to be treated differently from enclosed area for fees. |
| Swimming pool and deck | Yes | Usually yes | Setbacks, and in Jumeirah Islands lake setbacks and the waterfront edge. |
| Villa extension | Yes, plus area fee | Yes | Plot setbacks, the floor area allowance, structure and matching facade. |
| Garage conversion | Yes | Usually yes | May be refused where it removes required parking. |
| Balcony or terrace enclosure | Yes, plus area fee | Yes | Adds enclosed area, so it is treated like an extension. |
Fees and timelines
- NOC fees and deposit: Nakheel charges a modification NOC fee and holds a refundable security deposit. Published figures vary between communities and over time, so we confirm the current amounts for your plot.
- Additional gross floor area fee: charged on enclosed area added by extensions and enclosures, at a rate set by Nakheel.
- Authority fees: Trakhees or Dubai Municipality permit and inspection fees, depending on the community.
- Timeline: simple modifications are typically approved in a few weeks. Extensions, with the staged Nakheel review and the authority permit, typically take one to three months before work can start.
Developer and authority rules change, and they vary by sub-community, villa type and plot. This page summarises published developer guidance and our project experience as of October 2026. It is not a substitute for the current guidelines for your property, which we confirm before any design work starts.
